Someone drove into me. Genuine No fault of my own incident.
Going through green lights own nofault system.. they use a solicitors fitm called winns.
Is there justice in the system? I hope that there is. Ive heard tails of write offs and cat c and loss of no claims and increased premiums. We pay 100s and 1000s of pounds each year.
In this case i think its fair that i should receive the funds for a new door and rear wing painted and fitted.. and that be that! I expect nothing else.
I have already got no faith in the police. Twice they have ruined my life with points and insurance premiums going up for petty offences. Yet i catch them speeding around quite casually quite often! (I Didnt get caught speeding) They also give up on crime cases waaaay too easily like mine recently. Useless cunts..

If you were going through a green light on a fixed traffic light systems you can pretty much guarantee there would be cameras in place that would of recorded the moment in question. I cant off hand remember the website but you can ask for access to recorded for footage from public CCTV cameras. They after all public (tax payers) property. Just Google access to public CCTV. Insurance companies wise, I will not even get on my high horse just incase I fall off and make a claim.

Have the other party admitted liability? I had a no fault prang in an old Merc a few years ago. Other party admitted liability, I claimed through their insurance company to return my car to the condition it was in before the prang. Would have been a write off otherwise - new front end bodywork needed. I had no increase in premium.
Chris, I think Jack's referring to Greenlight insurance brokers.....

Yes green light insurance i ment. Sorry i cant articulate very well. They use a solicitors firm called winns. She admitted liability at the scene but i didnt get it on voice recorder or anything. She was very sorty i didnt see you etc. I did however take pictures and the cars were in the position that the collision happened. Pretty basic stuff. She just didnt check her mirrors and pulled out into me.
Fingers crossed that there is justice in the world and i get my car sorted am not penalised in anyway.

The whole system is prarrie canoe, I always wonder why they ask on insurance forms "have you had an accident in the last 5 years - whether your fault or not" How come they want to know if its not your fault!!?? Truth of the matter is insurance companies just love an excuse to hike a premium Its a scandal ooops just fell off my high horse

Its ok rich i was assuming the highhorsers would come in and justify this bullprarrie canoe!! Theylle be here soon im sure.
So basically if my car is deemed to be beyond eco repair i lose it to the opponents insurance company and have to buy it back off them for any price they wish!? And when i do buy my car back from the opponents insurance company (i still cant understand this) its cursed forever and will ruin my life just as previous years have done with high premiums with a cat d or c mark.
Any high horse mothers Canoeers out there ile punch in the face. Literally want to hurt quentin wilson i just watched an old top gear about him snapping up cat d c write offs. Canoeing Spikey Canoe.
Welle see how it goes.. and see if there is any justice in the world. Im not hopeful tho.

If the other person's insurance company admit their driver's liability, you should have nothing to worry about. Your car will be repaired regardless of it's value. Good luck!

It wI’ll be written off. Body shop would charge £2k plus for that repair easily. New door, rear quarter panel, wheel and then all the work to cut, weld skim and paint. Then you have the hire car costs on top.
They’d write off most cars under £5k for that damage, like my Mk3 if it were to happen to me. Lizzie’s mk2 10ae was written off for less damage but same area. Hers was just the rear quarter and not the door.
The best outcome is they write it off as a Cat C and pay out a good market value. At this point you need to agree with them that you wish to keep the car as salvage. They’ll hopefully let you keep the car and give you a cheque for the market value having removed the salavage value of the car, probably around £500, so you’ll be left with probably £1000 to £1500 and your car as it is. You can then fix it at your leisure.
There’s a few other elements to the above:
Value - unless you have a proper agreed value policy (IE you sent them photographs of the car not just told them it’s worth £xxxx) then the payout value will be a fight. They’ll low ball you with £1000 and hope you take it. You’ll have to fight to prove it was worth more.
Excess. If the claim goes against the other driver you’ll get this back. If it goes 50:50 which it might, you may not. They’ll deduct your excess from any amount they pay out to you. So if your excess is £400 and they value the car at £2,000 you’d get £1,600 as an example.
Cat C/D. Some insurers won’t cover Cat registered cars. Make sure you declare it when you re insure it. Cat C/D cars are worth less although with old MX5s it doesn’t make a huge difference. Worth noting if you have another knock in a Cat C/D the payout will be virtually nothing.
Renewal time. I suspect this claim will go down as 50:50 knock for knock claim. They always seem to, but I joke your sake it doesn’t. Even if it goes their fault you’ll still need to declare the claim at renewal time.
I think that’s it. Any questions just ask. Been through this whole process 3 times with my own cars and Lizzie’s.
And keep us updated with every step so we can give you advice.

When my MK1 was hit, by the Rumanian lorry in S Wales, it was repaired with no cost to me. I reckon if it had been my fault it would've been written off.

I've been Canoeed twice this year with crashes that weren't my fault and put my insurance up 500 quid.... Still dragging one out from June now...

Can I just check this?
Are you saying here that the moron other person's insurance company will deduct your excess from their payout?
Or that in a 50:50 situation (or, indeed, a 'fault' claim off your own insurance), your company will deduct your excess and then pay out [their 50% payout minus your excess amount]?
The latter I can understand, the former I didn't think was the case!

Jack has gone via his insurance company to make the claim, not the other drivers. Under those circumstances excess is payable and then Jacks insurance company will refund it when they are settled the full amount by the other parties insurance company.
